John Weadley (One grandson of Joseph Weadley of Millington) to Henry Hudson of Millington, Yeoman.

This ........[Tudruyun]???? made the Sixteenth day of September in the year of our Lord God one thousand seven hundred thirty and two. Between John Weadley of the City of York, Yeoman, one of the Grandsons and Devisees of Joseph Weadley late of Millington in the County of York, Yeoman of the one part, And Henry Hudson of Millington in the County of York aforesaid, Yeoman of the other part, Witnesseth that the said John Weadley for and in consideration of the sum of one hundred and seventy pounds of Good and Lawful money of Great Britaine to him in hand paid by the said Henry Hudson at the time of the sealing and delivery of the presents the receipt whereof the said John Weadley doth hereby acknowledge and thereof  and of every part and partoff thereof doth acquitt and discharge the said Henry Hudson, his heirs executors and administrators and every of them forever by these presents. And for diverse other Good causes and considerations the said John Weadley hereunto [Movsing]?? Hath given, granted, bargained, sold, Aliened[?], Released, Enforssed and confirmed And by these presents. .... Give Grant Bargain Sell Aliene Release En.e...e and Confirm unto the said Henry Hudson, his heirs and assignes forever ( In the actual possession of him the said Henry Hudson now being by Vertue of a Grant and bargaine and sale to him the said Henry Hudson thereof made by him the said John Weadley by Indentures for one year bearing date the day before the date hereof and by force of this statute made for transfering of Uses into possession) All that messuages or tennement with the Garth, Croft, Barns, Buildings and appurtenances thereunto belonging situate standing and being in Millington aforesaid lying between an house belonging to William Bell on the West and an house of Roger Bell on the East. Ann also all those four oxgangs of Arrable Land with the appurtenances lying disposed and being in the Township, Townfields and Territoryes of Millington aforesaid lying and adjoyning on the Lands belonging St John's Colledge in Cambridge on the West and James Hudson on the East. And also one and Land called a Town and? Land and one other Land called an Hallah bread ? Land within said messuage or Tenement, Oxgangs of Land and Lands and premises as now in gthe Towns or occupation of Richard Cooper as Tenant to the same. And also all other the Lands, Tenements and .er.ditaments whatsoever of him the said John Weadley situate lying and being in Millington aforesaid. Together with all the Barns, Buildings, Stables, Waters, Water sources, Comons, Comons of Pasture, Easments, paths, passages, .resits, Comodityes, Hereditaments and appurtenances whatsoever to the same Messuage, Oxgangs of Land and premises belonging or in any way wise? [or wife] of right appertaining And the Revertion and Revertions, Remainder and Remainders, Houses, Lands and profits thereof and of every part and parcell thereof. And also all the Estate right the? Interest claime and Demand whatsoever of him the said John Weadley of, in and to the said premises every or any part of partof thereof. And all Deeds, Evidences and writings ...thing or mentioning the same singly by themselves and true copies of such Deds, Evidences and Writings as .onth or reuturn the same joyntly with and amongst other Lands or Tenements which now are in the Lands, Custedy and keeping of the said John Weadley or any other person or persons for his Use and by and with his Assent consent or procurement All which Copies to be made or re.ied out at the Cost and Charges in the Law of the said Henry Hudson his heirs and Assigns. TO HAVE AND TO HOLD all & every the said hereby granted and released or mentioned or intended to be hereby granted and released premises with their and every of their appurtenances unto the said Henry Hudson his heirs and assigns. To the only proper Use, benefit and Behoofe of the said Henry Hudson his heirs and assigns forever. And to and for no other Use or Uses, intents, purposes or lymitations whatsoever. And the said John Weadley and his heirs the said hereby granted and released premises and every part thereof with their and every their rights, members and appurtenances unto the said Henry Hudson his heirs and assigns forever against him the said John Weadley and his heirs and against Joseph Weadley his brother and his heirs and against Robert Turner of Colchester, Clerk, and his heirs shall and will warrant and forever by these presents Defend. And the said John Weadley for himself, his heirs, Executors and Administrators and every of them doth hereby Covenant, Promise. grant and agree to and with the said Henry Hudson, his heirs executors and Administrators and Assigns, That he the said John Weadley at the time of the sealing and delivery of these presents is the Sole, True and Lawful owner of all and every the said hereby granted and released premises. And hath in him good right, full power and Lawful Tythe and Authority to give, grant, bargain, sell, aliens, release, enforsse and confirm the same to the said Henry Hudson, his heirs and assigns forever without any condition or lymitation whatsoever to alter, change, frustrate or make void the same or any part thereof. And that he the said Henry Hudson shall and may forever hereafter....... and quietly HAVE HOLD, Use, occupy, possess and enjoy all and every the said hereby granted and released premises and receive and take to his and their own proper use and benefit all the Issues, Rents, Revenues and profits from time to time ..ning, growing, Issuing or arising out of for or when the same without any less suit trouble, Ejection, Eviction deny all hinderents Interruption or Molestation whatsoever of him the said John Weadley his heirs or assigns or of the said Joseph Weadley or his heirs or assigns, or of the said Robert Turner or his heirs or assigns. And also free and clear of and from all former and other Bargains, Sales, Gifts, Grants, Wills, entailes, Ffines, Ffeoffments, Recovereyes, Statutes, Merchant and of the Staple Recequizantes, Annuityes, Joyntures, Dowers, Leases, Devises, Judgements, Executions, Extents, Rents, Rent charges, Mortgages and arrears of Rent and of and from all former and other titles, troubles, charges, claims and Incumberantes whatsoever had made done or suffered by the said John Weadley, Joseph Weadley and Robert Turner ..... of them or by any person or persons whatsoever lawfully claiming or claim by, from or under them ( the Rents and services from henceforth to become due and payable to the Chief Lord or Lords of the Ffee or Ffees thereof ( if any such be) only ...epted or foreprised. AND FURTHER the said John Weadley doth hereby for himself, his heirs, Executors and Administrators and every of them Covenant, promise, grant and agree to and with the said Henry Hudson, his heirs Executors, Administrators and Assigns and every of them, That he, the said John Weadley and his heirs shall and will for the further more perfect and better assureing and assuremaking in the Law of the said granted and released premises. To the said Henry Hudson his heirs and assigns forever, makedo, suffer, levy, acknowledge, and Execute or Cause to be made done, suffered, levyed, acknowledged and executed all and every such further and other lawful and reasonable art and arts, Deed and Deeds, Conveyance and Conveyances, assurance and assurances in the law whatsoever Bee it by Ffine or Ffines singly by themselves or joyntly with others and amongst Lands or Tenements Ffoefment, Recovery with single, double or more Voucher or vouchers, Deed or Deeds, Enrolled or not Enrolled the Enrollment of these presents Release confirmation or by any other Lawfull ways or means whatsoever. As by the said Henry Hudson, his heirs and Assigns or by his or their councill learned in the Laws of this Realm shall be i..senable, devised, advised or required so as the same may be made done and executed at the Costs and Charges in the Law of the said Henry Hudson, his heirs and Asigns, and the party or partys required to execute the same be not compelled to travell above Thirty Miles from house about the doing thereof. AND FURTHER it is hereby Covenanted, granted, declared, and agreed upon by and betwixt ye said partys to these presents for them and thier heirs. And they do hereby lymitt, declare and appoint that all Ffines, Ffoefments, Recoveryes and other assurances already had made done, suffered, acknowledged or executed or hereafter to be made done, suffered, levyed, acknowledged and Executed, of and upon the said premises or any part thereof by and betwixt the said partys to these presents or any of them whither singly or by themselves or joyntly woth others and amongstother Lands or tenements by the name or names aforesaid or by any other name or names Number of Acres discinction or discription whatosever shall be and ...re and shall be deemed Esteemed, adjudged, certified and taken to be and ...re to the only proper use, benefit and behoofe of the said Henry Hudson his heirs and assigns for ever and to and for no other use or uses, Intents, purposes or lymitations whatsoever. IN WITNESS whereof the partys to these presents have hereto sett their hands and seals the day and year Ffirst above written.
